5-5-07 Third Circuit Court of Appeals rules for Union in Lancaster Nissan case

The Third Circuit Court of Appeals has ruled to affirm the National Labor Relations Board (NLRB) and the Administrative Law Judges (ALJ) order against Lancaster Nissan, Inc. The NLRB AND THE ALJ had ruled the company violated the Federal Labor Law when they refused to bargain with District 98 at reasonable times during the certification year, and withdrew recognition. The NLRB ordered the company to continue to recognize the union and return to the bargaining table. The company appealed the ALJ's ruling to the full NLRB in Washington, DC. When the NLRB affirmed the ALJ's ruling the company appealed to the Third Circuit Court of Appeals.

Bob Myers,  District 98 Organizer, organized these employees in September 2002. District 98 Business Rep. Clark Ruppert, Jr. filed the unfair labor practice charges against the company in October 2003.

As of this date we do not know if the company will return to bargaining table or continue to stall by appealing the Third Circuits decision.

These workers have been denied a fair union contract for almost five (5) years This is just ONE of the many reasons why WE (YOU) MUST get our US Senators to pass the "EMPLOYEE FREE CHOICE ACT"!  To read more about the Employee Free Choice Act go to WWW.GOIAM.ORG  to take action click here. District Lodge 98 and the Central Labor Councils have post cards to fill out and returned to us, we will then send them to the National AFL-CIO who will get them to your Senators. If you have not filled out a card please see your local lodge officers, shop stewards.

12-06-06 - Please take note of the following information as reported in the IAM I-Mail for Tuesday December 5, 2006

National Magazine Misleads Seniors on Part D

A recent ad in Parade Magazine and elsewhere regarding the Part D open enrollment season that ends December 31 is deceiving readers.  The ad, placed by the Centers for Medicare and Medicaid Services (CMS), an agency of the U.S. Dept. of Health and Human Services, features a checklist where the second step incorrectly states, “If you are satisfied with your current cost, coverage and the customer service you receive, you don’t need to do anything.” The ad fails to explain that costs and coverage have changed for many of the prescription drug plans.

“CMS should explicitly mention that many plans have changed and while you may be happy with your current coverage, you need to make sure it will be there in 2007,” said Edward Coyle, Executive Director of the Alliance for Retired Americans. “The misleading nature of this ad follows the trend of CMS not revealing the entire truth about Part D to the public.”

Last year, while CMS and the Bush Administration were peddling the so-called benefits of Part D, CMS failed to mention that nearly 7 million beneficiaries would fall into what is now known as the “donut hole,” added Coyle. “Part D is still flawed, and deceitful ads such as the one by CMS won’t cover that fact.”

3-7-06  STERIS CORP. MOVING TO MEXICO!!!

Business Representative Tim Buck reports that the Steris Corp. plant in Erie, Pennsylvania is closing and moving to Mexico. There are 9 IAM Members and about 260 UAW members employed by Steris.

Thanks to NAFTA, the company can EXPLOIT the workers in Mexico for about a $4.00 cost per hour compared to our wage and benefit package cost of $38.00.

Steris makes STERILIZEING UNITS for HOSPITALS, DOCTOR Offices, and  DENTIST Offices.

There is a Quality Safety standard we need to be concerned with. In Erie, PA we have QUALIFIED EXPERIENCED DEDICATED UNION EMPLOYEES building these units.  MEXICO CANNOT OFFER THIS.

 We are asking you to:

1. Contact your local Hospitals, Doctors and Dentists and ask them to contact Steris and let them know that they want to buy or lease only sterilizers that are made in the United States by qualified and experienced union worker for quality, safety and job reasons.

 2. Contact your local and state representatives and ask them to oppose Steris' move to Mexico.

 3. Contact Steris and let them know that you are opposed to their moving to Mexico and that you will Boycott the use of units made in Mexico.

The contact numbers for Steris are telephone 814-452-3100 or Fax 814-870-8338.
